1. Acceptance of Terms

By accessing or using Swagged ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Eligibility

You must be at least 18 years old and a resident of Australia to use Swagged. By using our Platform, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • You may not use another person's account without permission

4. Buying and Selling

For Sellers:

  • You may only list items that you own and have the right to sell
  • All items must be authentic and accurately described
  • Prohibited items include counterfeit goods, stolen property, and items that violate any laws
  • You must ship items within 5 business days of sale
  • You agree to pay a 10% commission on successful sales

For Buyers:

  • You agree to pay for items you purchase
  • You must inspect items promptly upon delivery
  • Disputes must be raised within 7 days of delivery

5. Prohibited Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Post false, misleading, or fraudulent listings
  • Harass, abuse, or harm other users
  • Circumvent fees by conducting transactions outside the Platform
  • Use automated tools to access the Platform without permission
  • Interfere with the operation of the Platform
  • Infringe on intellectual property rights

6. Payments and Fees

  • Sellers pay a 10% commission on successful sales
  • Buyers pay the listed item price plus shipping
  • All payments are processed through our secure payment system
  • Seller payouts are issued within 3 business days after delivery confirmation

7. Buyer Protection

Swagged offers Buyer Protection for eligible purchases:

  • Items must be paid for through our Platform
  • Claims must be filed within 7 days of delivery
  • We may require photo evidence or return of items
  • Refunds are at our sole discretion

8. Intellectual Property

All content on the Platform, including logos, text, graphics, and software, is owned by Swagged or its licensors. You may not use, copy, or distribute our content without permission. By posting content, you grant us a license to use, display, and distribute that content on our Platform.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THE ACCURACY OF LISTINGS, THE QUALITY OF ITEMS, OR THE CONDUCT OF USERS. WE ARE NOT RESPONSIBLE FOR DISPUTES BETWEEN USERS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWAGGED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may also delete your account at any time through your account settings.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform. Your continued use of the Platform after changes constitutes acceptance of the new Terms.
